DISTANCE SALES AGREEMENT

1. PARTIES

This Agreement is signed between the following parties under the terms and conditions stated below.

1.1. SELLER:

1.2. BUYER: The person who requests a product or service through the SELLER's website. The contact and delivery information provided during the order shall be taken as the basis.

2. DEFINITIONS

In the implementation and interpretation of this agreement, the following terms shall represent the written explanations:

  • Minister/Ministry: The Minister/Ministry of Customs and Trade of the Republic of Turkey.

  • Law: Law No. 6502 on the Protection of Consumers.

  • Regulation: Distance Contracts Regulation.

  • Site: The website belonging to the SELLER (www.skinsilk-underwear.com).

3. SUBJECT

This Agreement regulates the rights and obligations of the parties in accordance with the Law No. 6502 and the Regulation on Distance Contracts regarding the sale and delivery of the product ordered by the BUYER electronically through the website.

4. PRODUCT AND ORDER INFORMATION

4.1. The basic characteristics (type, quantity, brand/model, color) of the products are published on the SELLER’s website. 4.2. The prices listed and announced on the site are the sales prices. The announced prices are valid until they are updated or changed. 4.3. All taxes, including VAT and shipping costs, are presented to the BUYER before the payment is completed.

5. GENERAL PROVISIONS

5.1. The BUYER acknowledges and declares that they have read the preliminary information regarding the basic characteristics, sales price, and payment method on the website and given the necessary confirmation in the electronic environment. 5.2. Each product subject to the contract shall be delivered to the BUYER or the person/organization at the address indicated, provided that it does not exceed the legal period of 30 days. 5.3. For international orders, any customs duties, import taxes, or local clearance fees are the sole responsibility of the BUYER.

6. RIGHT OF WITHDRAWAL & EXCEPTIONS

According to the Regulation on Distance Contracts (Article 15), the BUYER cannot exercise the right of withdrawal in the following cases:

  • 6.1. Personalized Goods: Products prepared in line with the consumer’s special requests or clearly personal needs.

  • 6.2. Hygiene-Sensitive Goods: Products whose protective elements such as packaging, tape, or seals have been opened after delivery and whose return is not suitable for health and hygiene (e.g., underwear, swimwear, and other hygiene-related items).

Note: Since the primary products sold on skinsilk-underwear.com consist of hygiene-sensitive items, returns and cancellations are not accepted for products whose packaging has been opened or the hygienic seal has been tampered with.

7. DEFAULT AND LEGAL CONSEQUENCES

In the event that the BUYER defaults on payment by credit card, the BUYER acknowledges that they will pay interest and be liable to the bank within the framework of the credit card agreement between the cardholder and the bank.

8. AUTHORIZED COURT

In disputes arising from this agreement, complaints and objections shall be made to the consumer arbitration committee or the consumer court where the consumer's residence is located or where the consumer transaction is made, within the monetary limits determined by the Ministry.

9. ENFORCEMENT

When the BUYER completes the payment for the order placed through the Site, they shall be deemed to have accepted all the terms of this agreement.
